margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">“最近我手上有个稳赚不赔的投资项目，你要不要试试？”几天后，“杜岩”告诉吴女士，自己可以帮她向公司特别申请一个投资名额。出于对“杜岩”的信任，吴女士决定试试。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">根据对方发来的二维码，吴女士下载了一款名叫“GKFX”的炒外汇App，并充值了100美金。令她意想不到的是，才过了10分钟，账户里的钱就涨了40%，吴女士当场提现了140美金。此后她又操作了两次，获利20%。随即吴女士被对方拉进了“杜老师VIP信息交流群”。在群里，“杜岩”作为投资大师，时常会在群内分享一些投资之道，加上群友们对他的疯狂追捧，吴女士更是对他的投资理财能力深信不疑。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">不久，“杜岩”在群内发布了一条美金投资计划，并私信怂恿吴女士投资。看着群内争相投资的情景，吴女士狠了狠心，投资了1万美金。本以为这次投资会像前几次一样顺利，没想到对方却回复称，吴女士因为操作失误导致投资全部亏损，同时自己也将面临公司的处罚，唯一的解决办法就是删除所有投资记录。不知所措的吴女士只能按照对方要求进行操作，但对方很快将她拉黑了。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">意识到受骗的吴女士向公安机关报案。2021年7月，桐乡市公安局立案侦查后，先后将贺某等44人陆续抓获归案。真名叫肖某的“杜岩”也在被抓获人员之列。</span></p><p style="margin-left: 8px; letter-spacing: 0.034em;">经过深入侦查，公安机关查获了一个盘踞在“金三角”的特大跨境电信网络诈骗集团。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">2020年9月至2021年12月，贺某等人在“金三角”组建“鸿宇公司”专门实施电信网络诈骗犯罪，从国内招募亲友到老挝参与诈骗。该诈骗犯罪集团实行公司化运营，内部各“股东”分工负责，将团伙成员分为数十个诈骗小组。吴女士遭遇的外汇投资诈骗只是“鸿宇公司”的犯罪手段之一，资金盘项目投资诈骗也是他们的“圈钱大招”。两种方式的“投资渠道”虽然不同，但诈骗手段相似。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">在吴女士遭遇的外汇投资诈骗中，团伙成员按照公司“话术”，使用微信等软件添加被害人，并通过编造金融专业工作人员人设、对被害人嘘寒问暖等方式骗取被害人的信任，再诱导被害人到“GKFX”等虚假的外汇平台注册投资。一开始，诈骗分子会故意让被害人用小额投资盈利并提现，适时安排团队成员控制多个微信号，在微信群以及直播间内充当水军烘托气氛，进一步骗取被害人的信任。等到被害人放松警惕后，诈骗分子就会忽悠其加大投资金额。但当被害人想要再次提现时，他们则通过操控平台控制被害人盈亏或以流水未达要求、操作失误等理由拒绝被害人提现，从而达到诈骗钱财的目的。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">区别于外汇投资诈骗打感情牌获取信任的方式，资金盘投资诈骗则是向被害人热情推荐虚假投资平台，并以注册送礼品、投资有返利、介绍他人投资有提成诱导被害人注册投资虚假平台。一旦被害人大额投资长期项目后，结果将是提现无望、血本无归。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">经过认真审查，2022年12月至2023年12月，桐乡市检察院先后对贺某等人以诈骗罪、偷越国（边）境罪提起公诉。法院经开庭审理依法作出上述判决。</span></p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"> </p><p style="margin-left: 8px; margin-right: 8px; line-height: 2em;"><span style="font-size: 18px;">在办案过程中，检察官根据不同涉案情形分门别类处置，细化出庭指控方案、增强指控力度，如根据犯罪人员层级制定相应的讯问模板，根据不同类型诈骗设计询问被害人要点，同时要求公安机关随案移送同步录音录像，对法律适用、数额认定等问题达成共识、记录成册，形成“专案侦办手册”。</span></p><p style="margin-left: 8px;
